The Financial Forest™

Terms of Use

Version 1.6 · Effective August 2026

This tool is available on the free trial and paid subscription plans described on the Plans page. Some accounts created during an earlier invitation-only period are still completing their transition to a paid plan and remain on the terms that applied when they joined. If you provide feedback, you agree it may be used to improve the tool without obligation or compensation. You can request deletion of your account and data at any time by contacting support@thefinancialforest.com.

1. Benchmarking data only, not financial advice

The Financial Forest Benchmarking Tool provides comparative statistical data derived from IRS Form 990 filings. Nothing in this tool constitutes financial, legal, tax, or accounting advice. Results are descriptive and positional. They describe where an organization sits relative to peers. They do not diagnose financial health, predict future performance, or recommend any course of action.

Users are solely responsible for how they interpret, present, or act on any output from this tool.

2. Accuracy and assumed risk

Benchmark statistics are derived from publicly available 990 data and are provided as-is. The Financial Forest makes no warranty, express or implied, regarding the completeness, accuracy, or fitness for any particular purpose of the data or calculations. Users assume full responsibility for verifying inputs and for any conclusions drawn from the output.

3. Attribution and removal of branding

Any output generated by this tool, including PDF exports, presentation views, screenshots, and summaries, must retain The Financial Forest name, logo, and trademark attribution. Removal or obscuring of attribution is prohibited. Outputs may not be represented as the user’s original research or presented in a manner that implies a different source.

4. Free trial

New accounts start with a 14-day free trial. No card is required to begin, and the trial does not convert into a paid plan on its own. The trial gives you full use of the comparison tools on up to three saved organizations, and it does not include PDF export, which is a paid feature.

When the 14 days end, your account moves to the free Classify tier rather than closing. Your saved organizations stay in your account and remain viewable, and the ability to add or edit them, and to open the comparison tools, resumes when you subscribe. Nothing you entered is deleted because a trial ended.

5. Subscriptions, billing, and cancellation

Paid plans are billed in advance, either monthly or annually, at the price shown on the Plans page when you subscribe. Subscriptions renew automatically at the end of each billing period, on the same card, until you cancel. Prices are in U.S. dollars and do not include any sales or use tax that may apply, which is added at checkout where required.

Cancelling. You may cancel at any time from the billing portal linked in your account settings. Cancellation takes effect at the end of the period you have already paid for, so you keep full access until then. We do not prorate or refund the unused part of a billing period, except where the law requires otherwise.

When a subscription ends. Your account moves to the free Classify tier. Saved organizations stay in your account and remain viewable. If you were holding more organizations than the tier you move to allows, you will be asked to choose which stay active; the rest remain in your account, read-only, and become active again if you resubscribe.

Failed payments. If a renewal payment fails, we will attempt it again over a short period. If it does not succeed, the subscription lapses to the free tier as described above.

Price changes. We may change subscription prices. Any change takes effect at your next renewal, never mid-period, and we will tell you before it does, so you can cancel first if you would rather not continue.

6. Classification credits

One credit classifies a single organization by EIN, reading the organization’s live IRS Form 990 record. A lookup for an EIN with no filing on record does not consume a credit. Monthly credits included with your plan expire at the end of each billing cycle and do not roll over; credits purchased separately as packs never expire. When you run a classification, your monthly credits are used first, then purchased credits.

Credit pack refunds. Credits from a purchased pack are delivered to your account instantly and can be spent right away. Because of that, credit pack purchases are non-refundable once any credit from the pack has been used, except where the law requires otherwise. If you purchased a pack and have not used any of its credits, contact us within 14 days and we will refund it. When a credit pack payment is refunded, or reversed through your card issuer as a chargeback, the unused credits from that purchase are removed from your account at the same time. Classifications you already ran, and the results they produced, are not affected.

7. Archetype Workbooks

Archetype Workbooks are downloadable PDF publications, sold individually or as a set and also included with certain plans. A workbook is licensed to the purchasing person or firm for use in its own advisory work with clients. You may print and hand out pages in sessions you personally facilitate, with the licensing notice left intact. You may not resell, redistribute, post, or forward the file itself, or share it outside your firm.

Workbook refunds. Because a workbook is a digital publication delivered immediately on purchase, workbook purchases are final and non-refundable, except where the law requires otherwise.

8. Acceptable use

Users agree not to:

  • Misrepresent benchmark outputs as guarantees of organizational performance
  • Use outputs to make binding financial representations to third parties without independent verification
  • Reverse-engineer, scrape, or reproduce the underlying dataset outside this tool
  • Share account credentials or allow unauthorized access to their workspace
  • Use an output as the sole basis for an adverse decision about another organization, including denying, reducing, or withdrawing funding. The tool describes where an organization sits relative to peers built from a specific sample, and a position in a distribution is not a finding about management quality or capacity.

9. Availability, changes, and account termination

We aim to keep the tool available and working, and we do not promise uninterrupted service. Access may be unavailable during maintenance, during an outage at one of the providers we depend on, or for reasons outside our control.

We may add, change, or remove features over time. If we remove something a paid plan described when you subscribed, and the change materially reduces what you are paying for, you may cancel and we will refund the unused part of the period you have paid.

We may suspend or close an account that violates these terms, particularly the acceptable use section above, or that we reasonably believe is being used to compromise the security of the tool or the confidentiality of another user’s data. Where circumstances allow, we will tell you first and give you a chance to put it right. If we close a paid account for a reason other than a violation, we refund the unused part of the period you have paid.

10. Limitation of liability

To the maximum extent permitted by law, The Financial Forest will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising from your use of this tool, even if advised of the possibility of such damages.

The Financial Forest’s total liability for any claim arising from or related to your use of this tool will not exceed the total amount you paid to The Financial Forest in the twelve (12) months preceding the event giving rise to the claim.

If a court finds any part of this limitation unenforceable, the remaining limitations in this section remain in full force.

11. Indemnification

You agree to defend, indemnify, and hold harmless The Financial Forest from any claim, damage, or lawsuit brought by a third party, including your own clients, arising from your professional advice, your interpretation of this tool’s output, or your use of this tool in violation of these terms.

Enterprise tier only: if your subscription includes white-label export, The Financial Forest will defend you against any third-party claim alleging that the underlying methodology, clustering framework, or dataset behind this tool infringes a patent, copyright, or trade secret, provided you promptly notify us of the claim and cooperate with our defense.

12. Governing law

These terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Any dispute arising from these terms will be brought exclusively in the state or federal courts located in Colorado, and you consent to that venue.

13. Data privacy

Financial inputs entered into the tool are stored securely in your workspace. They are not shared with third parties, sold, or used to train any AI model, and they are never shared with other users of this tool.

The Financial Forest may use combined, de-identified data, meaning your individual organization names, EINs, and financial figures are removed entirely, to maintain and improve the benchmark research the tool is built on. Nothing in that use can be traced back to your workspace or your clients. Aggregate, de-identified findings from that research may appear in materials The Financial Forest publishes, shares, or licenses; your individual data is never included in any such material.

You may delete saved organizations at any time from your account settings. To delete your account and all associated data, contact support@thefinancialforest.com.

14. Assignment

You may not assign or transfer your account or these terms to anyone else. The Financial Forest may assign these terms, together with your account and associated data, to a successor in connection with a merger, acquisition, reorganization, or sale of all or substantially all of the assets of the Bearings product or of The Financial Forest. Any successor must honor the commitments in these terms and in the Privacy Policy in effect at the time of the transfer, including the promises about how your data is and is not used. We will notify you of any such transfer, and your right to delete your account and data continues unchanged.

15. Changes to these terms

The Financial Forest may update these terms from time to time. Continued use of the tool after notice of changes constitutes acceptance of the revised terms. The version and effective date above reflect the terms you agreed to at account creation.
